General business conditions (user conditions) for using the internet portal www.radroutenplaner.Hessen.de (in the following called "Portal")
1. General
The Portal is provided to the user by ivm GmbH (Integriertes Verkehrs- und Mobilitätsmanagement Region Frankfurt RheinMain) Lyoner Straße 22, 60528 Frankfurt a. M. (in the following called "ivm"). The use of the Portal is subject to the following user conditions. On accessing the Portal, the user accepts these conditions. If he does not agree to the subsequent conditions, he is not entitled to use the Portal and must immediately stop using it. A breach of these conditions by the user leads to an immediate exclusion from using this service. Such an exclusion can be irrevocable.
2. Scope of services and costs / Availability
The main task of the Portal is to promote tourism in the state of Hesse by providing the user with services as to "Cycling routes in Hesse". These services are currently free of charge for the user. The user can partly personalize the services by means of a profile available on the servers of ivm or on those of a company appointed by ivm. The user is responsible for all operations carried out by him when using the services; this also applies to all operations carried out via his ivm account.
ivm is making all efforts to avoid interruptions which may result from technical problems. However, ivm cannot guarantee the availability and the uninterrupted functioning of the Portal and of its services at all times.
As a result of maintenance works and/or upgrading of services, the use may be limited and/or temporarily interrupted. Moreover, the information transfer via internet can be subject to faults, delays or errors in data supply, being beyond the responsibility of ivm. These interruptions, delays and errors may also produce the loss of entries of the user (data loss). ivm is not responsible for direct or indirect damages and consequential losses which may result from such limiting circumstances.
ivm expressly reserves the right to change, supplement, and delete parts or the entire Portal without previous notification or stop publication temporarily or permanently.
3. Duties of the user
The user is bound to use all the contents of the portal exclusively for the personal use. It is not permitted to use the services of the portal for commercial purpose without the written approval of ivm. The user is further bound not to breach the legal regulations while using the services of ivm.
4. Provisioning of the services/ liability
The user may use the contents provided via portal at his/her own risk. Neither ivm, nor the third party guarantees that the information is updated, corrected, exact and/or complete. Liability claims against ivm, which are based on the direct or indirect damages of material or goodwill, which were caused by using the available information or by using erroneous and/or incomplete information or are the result of linking to other websites, are ruled out. ivm would like to point out to the user that the route recommendations of the portal are based on the basis of simplified network basics (e.g. no information is available for one-way streets across the country) and thus there may be route sections in individual cases, which cannot be driven by bicycle or where the ability to ride is limited or there may be increased risk for the cyclists on using the route due to traffic. The user cannot initiate claims against ivm.
5. Copyrights
Content, structure and services of the portal and the data (software, pictures, texts, photos) are protected by the copyright law. The copyright is possessed by ivm, unless otherwise mentioned. All rights reserved. All the brands and trademarks mentioned in the portal are subject to the regulations of the applicable labelling right and, sometimes, the ownership rights of the noted owners. Downloading and using the trade name, logos, emblem and labels is prohibited. This is not applicable in case these objects are permanent components of the services provided by ivm to the user (e.g. while printing the map material). ivm grants the right to each user of the portal, which is not transferable, to use the offered services exclusively for individual use; never for commercial use. This is applicable unless revoked by ivm. The user may not copy, transfer or change the display, data and services of the portal. The user is prohibited to produce products derived from structures, display, data and services on this site. The user is further prohibited to forward or provide the aforementioned products and services to the third part in any form.
6. References and links
On creating the Portal, ivm thoroughly checked the hyperlinks placed on the Portal as well as the contents of the linked offers. Nevertheless, a change of the contents by a provider cannot be ruled out. ivm is not bound to continuously check those contents and thus assumes no liability for them. Any web page provider may get access to the Portal by means of a hyperlink. This is technically possible, without ivm becoming aware of it. Hence, ivm assumes no liability for any contents appearing on a third party’s web pages.
Any content of illegal and immoral character or contravening public order is not permitted to be hyperlinked to the Portal from web pages.
Hence ivm clearly dissociates from any such contents of any pages of the kind, linked from the Portal. This declaration applies to all links published on the Portal and to any contents of those pages to which banners and links published on the Portal, may lead.
7. Data protection
If the Portal offers the possibility to enter personal or business data (e-mail addresses, names, addresses in general, etc), relinquishment of these data by the user is on a voluntary basis.
ivm is bound to responsibly handle the personal data of the user and to strictly adhere to the data protection law in force when making use of those data. ivm will neither sell nor lease personal data, nor make them otherwise available to any third party.
8. Miscellaneous
Any information offered through the Portal is of purely informational character. Information is mainly based on sources accessible to the public. Information is made available to ivm by: the states of Hesse and Rhineland-Palatinate; rural districts and cities of Hesse; Regionalverband FrankfurtRheinMain (development association of Frankfurt/Rhine-Main agglomeration); travel agencies and other service providers and institutions (like e.g. ADFC-Allgemeiner Deutscher Fahrrad Club – being a German bicycling organisation)
